Terms and Conditions for DESIGNS BY GOMES LTD

Effective from: date of signed agreement

Please read these Terms and Conditions carefully before using the services provided by DESIGNS BY GOMES LTD.

By accessing our services, you agree to be bound by these Terms.

  1. Services Provided

1.1. DESIGNS BY GOMES LTD provides web design and development services, including but not

limited to website creation, hosting, maintenance, and additional features as agreed upon by both

parties.

1.2. Any additional services, including content creation, graphic design, or marketing services, may

incur additional fees and will require separate agreements.

 

  1. Customer Obligations

2.1. The customer agrees to provide all necessary information, materials, and cooperation needed to

complete the project. Failure to provide timely information may result in delays and potential

additional fees.

2.2. The customer is responsible for reviewing all drafts and providing feedback within the agreed-

upon timelines.

2.3. The customer agrees that all content (text, images, videos, etc.) provided to DESIGNS BY GOMES LTD

is either owned by the customer or legally licensed for use.

 

  1. Fees and Payment Terms

3.1. A deposit of 50% of the total project cost is required before work commences. The remaining

balance will be due upon project completion or as agreed.

3.2. Payments must be made within 2 days of invoice issuance. Failure to pay within this time

frame may result in a suspension of services, including disabling access to the website.

3.3. Additional fees may apply for changes or revisions outside the scope of the initial agreement.

3.4. If the customer cancels the project after the deposit has been paid, the deposit is non-

refundable. Any additional fees for completed work will also be due.

 

  1. Revisions and Approvals

4.1. We will provide 2 rounds of revisions. Additional revisions beyond this number may be charged

at an hourly rate.

4.2. Final approval of the website must be provided in writing before the website goes live.

 

  1. Intellectual Property

5.1. Upon full payment, the customer will own the rights to the website design and content,

excluding any third-party components such as plugins, software, or licensed media.

5.2. DESIGNS BY GOMES LTD retains the right to display the completed project in its portfolio and

promotional materials.

 

  1. Website Hosting and Maintenance

6.1. DESIGNS BY GOMES LTD may offer website hosting and maintenance services. These services

will be billed separately, and the terms of these services will be outlined in a separate agreement.

6.2. We are not responsible for downtime, data loss, or security breaches caused by third-party

hosting providers.

6.3. The customer is responsible for maintaining regular backups unless a backup service is included

in the maintenance plan.

 

  1. Termination

7.1. Either party may terminate the agreement with 7 days’ written notice.

7.2. Upon termination, the customer will be responsible for paying for all completed work and any

non-cancelable costs incurred by DESIGNS BY GOMES LTD.

7.3. DESIGNS BY GOMES LTD reserves the right to terminate or suspend services if the customer

fails to comply with these Terms or engages in illegal, unethical, or harmful activities.

 

  1. Limitation of Liability

8.1. DESIGNS BY GONES LTD will not be liable for any indirect, incidental, or consequential

damages, including but not limited to loss of profits, data, or business opportunities.

8.2. Our total liability under these Terms will not exceed the total fees paid by the customer for the

services provided.

 

  1. Warranties and Disclaimers

9.1. We warrant that the services provided will be delivered in a professional manner, conforming to

industry standards.

9.2. However, we do not guarantee that the website will be error-free, uninterrupted, or immune

from hacking, malware, or other malicious activities.

9.3. DESIGNS BY GOMES LTD disclaims all other warranties, express or implied, including but not

limited to warranties of merchantability or fitness for a particular purpose.

  1. Confidentiality

10.1. Both parties agree to keep all confidential information provided by the other party confidential

and not to disclose it to third parties without written consent, except as required by law.

 

  1. Governing Law

11.1. These Terms will be governed by and construed in accordance with the laws of England &

Wales. Any disputes will be resolved in the courts of England & Wales.

 

  1. Amendments

12.1. We reserve the right to modify these Terms at any time. Any changes will be communicated to

customers in writing and will take effect 5 days after notice has been provided.
